Terms of service for Nutzy

1. Introduction
Welcome to Nutzy. These Terms of Service ("Terms") govern your use of our app. By accessing or using Nutzy, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our app.
2. Use of the App
You agree to use Nutzy in accordance with all applicable laws and regulations. You are responsible for your own use of the app and for any consequences thereof.
2.1 Account Registration
To use certain features of Nutzy, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account password and for any activities or actions under your account.
3. User Conduct
You agree not to engage in any of the following prohibited activities:
- Using the app for any unlawful purpose or in violation of any local, state, national, or international law;
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
- Interfering with or disrupting the app or servers or networks connected to the app;
- Distributing viruses, malware, or any other harmful code;
- Collecting or storing personal data about other users without their express permission;
- Engaging in any activity that could damage, disable, overburden, or impair the proper working of the app;
- Using any automated system, including without limitation "robots," "spiders," or "offline readers," to access the app;
4. Intellectual Property
The app and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Nutzy, its licensors, or other providers of such material and are protected by intellectual property laws.
5. Termination
We may terminate or suspend your account and access to the app immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the app will cease immediately.
6. Disclaimer of Warranties
The app is provided on an "AS IS" and "AS AVAILABLE" basis. Nutzy makes no representations or warranties of any kind, express or implied, as to the operation of the app or the information, content, or materials included on the app. You expressly agree that your use of the app is at your sole risk.
7. Limitation of Liability
To the fullest extent permitted by law, Nutzy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the app; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the app; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our app by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the app; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
8. Governing Law
These Terms shall be governed and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
